TERMS AND CONDITIONS

We invite you to visit the "Cosmindie" portal, through which you can
stream and download digital content on-demand or via subscription
plans. To access these services, it is necessary to carefully read the
following information and accept our Terms and Conditions of Use.
Please note that this document is an agreement between "Cosmindie"
and you, the user of our services. By accessing and registering to use
the services, you agree to comply with these terms as presented.
Alterations, additions, or deletions made by the user are
unacceptable.

1 - General Information

Our services are available to users aged 13 and older. If you are
between the ages of 13 and 18, you must review these terms and
conditions with your parents or guardians to ensure that you or your
parents or guardians have understood these terms and conditions.

Considering that the use of the services involves hardware, software,
internet access, and compatible equipment, your ability to use them
may be affected by the performance of these factors.

You agree to comply with the rules and policies established
periodically by "Cosmindie."

The email address provided by you and your password will be used
for your identification and access permission to the services.

Notwithstanding any other provision of this agreement, "Cosmindie"
reserves the right to alter, suspend, remove, or disable access to any
content or other materials offered by the service at any time without
prior notice.

Under no circumstances will "Cosmindie" be responsible for the
removal or deactivation of access to any content or materials
available. "Cosmindie" may also impose limitations on the use or
access to certain features or parts of the service, in any case, without
prior notice or liability.

You understand that by using the Service, you may encounter content
that some may consider aggressive, indecent, or offensive, which may
or may not be identified as explicit material. However, you agree to
use the Service at your own risk, and "Cosmindie" shall have no
liability to you for content that may be considered aggressive,
indecent, or offensive by any person.

You, the user, understand and agree that:

a) "Cosmindie" includes security components to protect the
information available on our portal;

b) "Cosmindie" may limit the use and access to the portal so that
digital files can only be used as authorized by the rules established by
"Cosmindie," artists, authors, and/or record labels;

c) "Cosmindie" may periodically send you news, information about
promotions, updates on your account, requests for user interaction,
and similar topics via email;

d) you will not use or attempt to use our services outside the available
territory;

e) you will provide true, accurate, up-to-date, and complete
information when registering in the specific form to access the
services;

f) you will keep and regularly update your registration information to
keep it true, accurate, up-to-date, and complete. If any information
provided is found to be false, incorrect, outdated, or incomplete, or if
"Cosmindie" has sufficient reason to suspect that the information
provided is false, incorrect, outdated, or incomplete, "Cosmindie" shall
have the right to immediately suspend or cancel your user account,
regardless of notification, and deny any and all present or future use
of the services, or any part thereof;

g) "Cosmindie" may store and use the registration data you provide
(including credit card information) for account maintenance and credit
card fee charges;

h) you will immediately notify "Cosmindie" of any unauthorized use of
your account or any other security breach. "Cosmindie" shall not be
liable for any loss due to unauthorized use of your account;

i) each form of payment (or phone number, prepaid card, credit card,
or PIN codes) is related to a single "Cosmindie" account and cannot
be transferred to other accounts of other service users.

It is the user's sole responsibility to:

a) provide their own internet access (whether through a PC or
terminal), paying all charges for service eventually charged by third
parties for such access;

b) provide their own access to an email address via the internet,
paying all service fees eventually charged by third parties for such
access;

c) provide all equipment necessary to establish their internet
connection;

d) complete their own registration on the portal, providing their email
address for identification and receipt of messages derived from their
registration in the said environment;

e) create a password, being solely responsible for its confidentiality, as
well as for any activity that occurs within the scope of their registration.
You can change your password at any time, but you will be solely
responsible for maintaining the confidentiality and security of your
account, being fully responsible for all activities that occur on your
account or through it. You must not disclose your account information
to anyone or use another person's account;

f) keep your computer and/or equipment compatible with the use of
available tools secure, such as antivirus and firewalls, among others.
Keeping them updated is essential to contribute to the prevention of
electronic risks on the user's side, as long as these protection tools do
not interfere with the use of the service.

g) provide, at your own expense, hardware and software capable of
reproducing the digital files available in the Service. To this end,
"Cosmindie" will always keep a list of minimum computational
requirements and a list of compatible equipment available for users to
enjoy the services satisfactorily. You acknowledge and agree that such
requirements may be modified from time to time, and any equipment
(hardware) and software (software) updates are your responsibility.

2 - Privacy of Our Visitors

"Cosmindie" has a stated policy on Online Privacy. User registration
information and other user information are subject to processing as
determined by this policy.

For more information, please consult the "Privacy Policy" document
available on the portal's homepage. This document is an integral part
of these Terms and Conditions of Use of the portal and should be read
carefully by all users before acceptance and use of the portal.

3 - Rights and Duties of Users

"Cosmindie" and all materials available on the portal, including but not
limited to images, software, texts, and digital music, are available for
personal use only.

You, the user, agree and warrant that when streaming and/or
downloading digital files, you do so for your own personal use and
entertainment, and you are not allowed to redistribute or share them
with third parties in any way.

Downloading any content provided by "Cosmindie" does not confer
any rights to public reproduction or ownership thereof.

Therefore, you are prohibited from distributing, transferring, renting,
lending to third parties, for consideration or free of charge, renting,
changing, modifying, selling, reselling, or transmitting any material
contained on the portal, including but not limited to any text, image,
audio, or software, for any purpose or purpose, under penalty of
violation of civil laws, criminal laws, and specific legislation on
copyright and intellectual property.

4 - Usage Limitations

Licensing is the way you enable the song, video, or any other digital
content available on "Cosmindie." To download or stream online, you
need to be connected to the internet. If you use the offline streaming
model, you must also be connected to the internet to access the song
for the first time. Subsequently, to access the song without an internet
connection, you must be up to date with the selected service payment.

The license granted by "Cosmindie" is non-exclusive, non-
transferable, and revocable at any time and for any reason justified by
the limitations of this agreement.

Allowed uses:

Through a computer or other portable device: All content downloaded
by the Service can be played indefinitely, with no limit to playback,
except for some files that have an expiration date or validity; these will
only function for a certain number of days, information that will be
clearly available to portal users.

For exclusively personal use, the transfer to other devices (MP3
players, for example), portable devices that support the MP3 format,
as well as copying to writable CDs or DVDs, may be copied or
transferred to another computer, within the limits imposed by the
copyright holders involved, respecting copyright and intellectual
property laws in effect in the country. Through a mobile device:

The song can only be played on the device on which it was
downloaded, as the OMA DRM format does not allow the file to be
played on other mobile devices or portable devices.

Downloading this type of content can be done up to five times and
cannot be replaced if lost for any reason. You are responsible for
backing up your own system. After the content is licensed following
the download, it is your responsibility not to lose, destroy, or damage
the content. "Cosmindie" will have no responsibility to you in the event
of any loss, destruction, or damage.

Access to portal content via streaming occurs in the same way for
computers or mobile devices. Prohibited Uses: Any use of recordings
available on "Cosmindie," other than that allowed above, is expressly
prohibited and constitutes copyright infringement and intellectual
property rights violation, subject to current copyright law.

It is also prohibited to reverse-engineer to circumvent the copyright
protection system, translate, adapt, modify, disassemble, alter the
content or software, or any technology used to enforce the "Usage
Limitations." You accept and warrant that you will not attempt to
modify the software or usage rules for any reason or engage in other
activities aimed at removing or circumventing the rights of the content
creators, being responsible for any damages caused to "Cosmindie"
and third parties.

5 - Usage Rules

You acknowledge that the Service uses security technology to limit the
use of content. You agree to use it in accordance with the applicable
Usage Rules.

Usage Rules:

The use of our services is subject to the prior acceptance of the terms
of this Agreement;

(b) You agree not to attempt to, encourage, or assist others in
circumventing or modifying any software program or security
technology that is part of the Service or is used to administer the
Usage Rules.

(c) Downloading content does not transfer any promotional use rights
to you.

(d) By obtaining a license for the content, you agree and understand
that its use will be in accordance with the Usage Rules, and any other
use of such content may constitute a copyright violation. Security
technology, if applicable, is an integral part of the content. "Cosmindie"
reserves the right not to make available or publish any material, as
well as to delete, withdraw, or edit any material, at any time, at its sole
discretion, without notice or liability.

"Cosmindie" has the right, but not the obligation, to monitor any
information and material submitted or posted by you or otherwise
available on the Service, to investigate any reported or apparent
violations of this Agreement, as well as to take any action that
"Cosmindie" deems appropriate at its sole discretion.

6 - Intellectual Property

All audio clips, image clips, photographs, graphics, editorial content,
trademarks, and logos available on the portal are protected by
applicable intellectual property laws and other laws, including, but not
limited to, the Civil Code and Copyright Law. These rights belong to
"Cosmindie" or have been granted to it by its rights holders, so
"Cosmindie" may use this material as part of this portal.

By accessing the portal, you declare that you will respect all
intellectual and industrial property rights, as well as all copyright rights
related to third parties that may be or have been in any way available
on the portal. You are not granted any right to use the names, titles,
words, phrases, trademarks, patents, literary, artistic, literary-musical,
and other works that may be or have been available in it.

You will not use such materials or information in any way except for
the use of the Service in accordance with the conditions of these
Terms and Conditions of Use. Reproduction of any part of the Service
in any form or medium, except as expressly permitted in this
instrument, including appropriation or network capacity overload, is
expressly prohibited. You agree not to modify, rent, lease, lend, sell,
distribute, create derivative works or based on the service provided by
"Cosmindie," in any way unauthorized.

Temporary archiving of this portal is allowed, and its use for
commercial, advertising, or any other use contrary to the reality for
which it was conceived as defined in this Agreement is prohibited.

However, making copies for personal use and archiving is allowed,
with the parts that allow a faithful and true understanding of its content
and purpose not being separated.

The use of the software or any other part of the Service, except for the
purpose of use permitted by this Agreement, is expressly prohibited
and violates the intellectual property rights of third parties, and the
user may be subject to pecuniary compensation for copyright
infringement, as well as other criminal penalties that correspond.

The user assumes all and any civil and/or criminal responsibility for
the improper use of the information, texts, graphics, trademarks,
works, and all and any intellectual or industrial property rights of this
portal.

7 - Account and Password

To use the Service, you must open an account on the portal in your
own name. You cannot do so on behalf of third parties.

At the end of the account registration process, you must choose a
password and identification, becoming fully responsible for
maintaining its confidentiality, and therefore responsible for all
activities that occur when using your password and/or identification.

You agree and are obligated to:

(a) use a secure password, with a minimum of 6 alphanumeric
characters, without using personal data such as your own name,
initials, relatives, following security patterns and minimum security
requirements;

(b) log out of your User account at the end of each session and
ensure that it is not accessed by unauthorized third parties.

"Cosmindie" shall not be responsible for any loss or damage resulting
from your failure to comply with this clause;

account or any other security breach you become aware of.

8 - Changes to these Terms and Conditions

"Cosmindie" reserves the right to unilaterally modify these Terms and
Conditions of Use at any time without prior or subsequent notice.

By browsing this portal, you acknowledge and agree to be bound by
the Terms and Conditions in effect on the date of your visit, so you
should review them each time you visit this portal. Continuing to use
the service after a change in these terms and conditions will signify
your express acceptance of the new terms and conditions; therefore, if
you do not agree, you can terminate the service at any time, without
prejudice to payment for outstanding services.

9 - Use of the Portal and its Links

In no event shall "Cosmindie" be responsible for the use of its portal or
access to links indicated on it, as well as for acts practiced by users
based on information obtained on the portal and links.

Certain content and services available on the portal may include third-
party materials. "Cosmindie" is not responsible for the content,
policies, privacy practices, or accuracy of any material on web pages
linked to our portal (external links leading to the "Cosmindie" portal) or
for those we link to (internal links leading to various web pages).

Additionally, "Cosmindie" is not responsible for verifying or evaluating
the content or web pages of third parties; thus, it does not provide
guarantees or endorsements and will not have any responsibility or
obligation for any material, products, or services or third-party web
pages.

You declare that you will not use any third-party material to infringe or
violate the rights of any other party and that "Cosmindie" will not in
any way be responsible for such use by you.

10 - Waiver of Indemnification

You agree to indemnify and hold harmless "Cosmindie," its parent
companies, subsidiaries, affiliates, advisors, shareholders, directors,
employees, contracted agents, licensors, partners, and customers that
display their brands in conjunction with "Cosmindie" from any
complaint arising from any violation of these Terms and Conditions of
Use by you, the User. Losses and damages that may be demanded,
including legal costs and attorney's fees, due to User misconduct,
whether in the use of the service, in violation of these Terms of
Service, or in violation of any rights, will be fully borne by the User.

Furthermore, you agree not to sue "Cosmindie," its parent companies,
subsidiaries, affiliates, advisors, shareholders, directors, employees,
contracted agents, licensors, partners, and customers, for example,
for refusing or deleting the processing of any information or content,
warning, suspending or ceasing your access to the service, taking any
other action during an investigation of suspected violation or after a
violation has been found of this instrument.

11 - Disclaimer of Warranty

"Cosmindie" does not provide any warranty, representation, or
endorsement that the use of its services will be uninterrupted or error-
free. You agree that periodically "Cosmindie" may remove the Service
for indefinite periods of time or even cancel the Service at any time
without prior notice.

You expressly agree that the use or inability to use our services is at
your own risk. All our content and services are offered "as is" and "as
available" for your use, without warranties of any kind.

In no event shall "Cosmindie," its parent companies, subsidiaries,
affiliates, advisors, partners be liable for any direct, indirect, incidental,
punitive, special, or consequential damages arising from your use or
any complaint related to your use of our services, including but not
limited to errors and/or omissions in any content.

You acknowledge and agree that any information you submit related
to our services is done at your own risk. However, "Cosmindie" will
make reasonable efforts to protect this information. Nevertheless, it
disclaims all liability towards you for loss or liability in any way related
to this information, as it does not declare or warrant that the Service
will be free from loss, corruption, attacks, viruses, interference, illegal
access, or other security breaches.

12 - Limitation of Liability

YOU EXPRESSLY ACCEPT AND ARE AWARE THAT "COSMINDIE"
SHALL HAVE NO LIABILITY, WHETHER CONTRACTUAL OR
EXTRA-CONTRACTUAL, FOR ANY PROPERTY OR MORAL
DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR
LOST PROFITS, LOSS OF GOODWILL, OR OTHER INTANGIBLE
LOSSES RESULTING FROM:

(I) USE OR INABILITY TO USE THE SERVICE;

(II) COST OF ACQUIRING GOODS OR SERVICES OTHER THAN
THROUGH THE PURCHASE OF GOODS, INFORMATION, AND
DATA THROUGH THIS SERVICE, OR RECEIPT OF MESSAGES,
OR TRANSACTIONS MADE THROUGH THIS PORTAL;

(III) UNAUTHORIZED ACCESS TO USER TRANSMISSIONS OR
INFORMATION, AS WELL AS THEIR ALTERATION;

(IV) GUIDANCE OR CONDUCT OF THIRD PARTIES REGARDING
THE SERVICE;

(V) DUE TO FORCE MAJEURE OR ACTS PERFORMED BY THE
USER HIMSELF.

CIRCUMSTANCES FOR REFUND OF AMOUNTS CHARGED THAT
RESULT FROM:

(I) INCOMPATIBILITY BETWEEN HARDWARE AND SOFTWARE
USED BY THE USER WITH THE SERVICES PROVIDED BY
"COSMINDIE";

(II) USER'S EQUIPMENT IF IT DOES NOT MEET THE MINIMUM
COMPUTER REQUIREMENTS FOR RUNNING COPYRIGHT-
PROTECTED MUSIC FILES;

(III) ERROR ATTRIBUTABLE SOLELY TO THE USER REGARDING
HIS SERVICE EXPECTATIONS;

(IV) FAILURE OF THE USER TO OBSERVE THE PROCEDURES
ESTABLISHED IN THIS AGREEMENT AND INSTRUCTIONS
PROVIDED ON THIS PORTAL;

(V) ACTS OF BAD FAITH;

(VI) CANCELLATION OF THE SERVICE WHEN IT HAS ALREADY
BEEN CONCLUDED;

(VII) UNJUSTIFIED DENIAL BY THE USER TO PROPERLY
PROCEED THROUGH THE STAGES OF DOWNLOADING AND
LICENSING DIGITAL CONTENT.

CIRCUMSTANCES FOR REFUND OF AMOUNTS CHARGED THAT
RESULT FROM:

(I) INCOMPATIBILITY BETWEEN HARDWARE AND SOFTWARE
USED BY THE USER WITH THE SERVICES PROVIDED BY
"COSMINDIE";

(II) USER'S EQUIPMENT IF IT DOES NOT MEET THE MINIMUM
COMPUTER REQUIREMENTS FOR RUNNING COPYRIGHT-
PROTECTED MUSIC FILES;

(III) ERROR ATTRIBUTABLE SOLELY TO THE USER REGARDING
HIS SERVICE EXPECTATIONS;

(IV) FAILURE OF THE USER TO OBSERVE THE PROCEDURES
ESTABLISHED IN THIS AGREEMENT AND INSTRUCTIONS
PROVIDED ON THIS PORTAL;

(V) ACTS OF BAD FAITH;

(VI) CANCELLATION OF THE SERVICE WHEN IT HAS ALREADY
BEEN CONCLUDED;

(VII) UNJUSTIFIED DENIAL BY THE USER TO PROPERLY
PROCEED THROUGH THE STAGES OF DOWNLOADING AND
LICENSING DIGITAL CONTENT.

13 - User Support

"Cosmindie" will always provide its users with a channel for
clarification of doubts and complaints related to the Service through
the email address: [email protected]

14 - Termination by "Cosmindie"

In the event that you do not comply, or "Cosmindie" suspects that you
have not complied with any of the provisions of this Agreement,
including, among others, the failure to pay the fees due, the failure to
provide "Cosmindie" with a valid credit card, or accurate and complete
Registration Data, the failure to protect your Account information, or
the violation of the Rules of Use or any software license, or the
bankruptcy or violation of third-party rights, "Cosmindie," at its sole
discretion, without notice to you, may: (i) terminate this Agreement
and/or your Account, and you will remain responsible for all amounts
due under your Account up to the date of termination, inclusive; and/or
(ii) terminate the software license; and/or (iii) deny access to the
Service (or any part thereof); and/or (iv) modify, suspend or
discontinue the Service (or any part thereof) at any time, with or
without prior notice to you, and "Cosmindie" shall not be liable to you
or third parties if it exercises these rights.

15 - Applicable Law and Jurisdiction

These Terms and Conditions of Use are governed by the laws of the
United Mexican States. Users of the "Cosmindie" portal expressly
agree that any complaint or dispute arising from this Agreement or in
any way related to your use of the Service will be exclusively heard by
the court of Mexico City.

16 - Information Security Suggestions

You can also help us protect your online security. We have some
suggestions:
• Never reveal your password to anyone.
• Be careful when choosing your password(s). Do not use obvious

passwords such as your name, initials, date of birth, etc. Create
a password that includes a combination of numbers and letters.

• If at any time you have given your password to third parties,
change it immediately (see User Support, Password Change).

• Your equipment may not "catch" a virus just by opening an email;
but if the email requests a password, billing information, or
contains an attached file sent by someone you don't know, do
not open it.

• Never download files unless you know who sent them and that
you have requested such a file. Viruses and malicious programs
that can disclose personal information are often transferred in
disguised files.

• We have a secure technological environment. Communication
between your computer and "Cosmindie" during the registration
and/or change of your registration data and password uses
standard encryption, the SSL protocol - Secure Sockets Layer.
However, no data transmission over the Internet is entirely
secure. Thus, despite "Cosmindie's" efforts to ensure the privacy
of your data, both in storage and transmission, "Cosmindie"
cannot guarantee complete security.

17 - Payment

The Service accepts credit card payment (Visa or MasterCard) for
both national and international cards (issued by a Banking Institution).
Gift cards (e-wallets), even if issued by Visa or MasterCard, are not
accepted.

To make a credit card payment, you must have previously read and
accepted the terms and conditions established by T1 Payments and
accepted its Privacy Policy. T1 Payments is solely responsible for the
processing of data collected for credit card payment, as well as for any
clarification related to the payment transaction.

To change the payment method in your account, you need to go to
"Settings" and the "Capital" section, where you can manage the
various payment methods available on "Cosmindie."

When making a payment with a credit card, T1 Payments may
generate a pre-approval charge of up to the total amount of the order
to ensure that there are sufficient funds for the subscription or content
purchase. The card will be charged at the time of content download or
subscription activation. It's important to note that credit cards may be
subject to a daily spending limit set by the issuing bank. If you have
exceeded your bank's limit, the payment will not be possible, and the
transaction will be denied.

If the credit card payment transaction is denied, check that you have
not exceeded the daily spending limit and that the provided data is
correct and up to date, and try again. If the transaction is denied again
by the issuing bank, for your security, you will not be able to use the
same credit card again and will need to replace it with another or
choose another payment method. Retrying with a previously denied
card may result in it being blocked by the issuing bank. If this
happens, contact your bank directly.

The payment for the Unlimited Monthly subscription and monthly
download plan will be applied every 30 days, depending on the type of
subscription, to the payment method you have chosen until you
request the cancellation of the service. The inability to make the
corresponding payment will result in the suspension of the subscribed
service or the withholding of downloaded content.

If you fail to make the payment on time, the service will be suspended
and/or pending content downloads will be withheld. To download
pending content and/or reactivate your subscription service, you will
need to settle the overdue and unpaid charges with another available
payment method. Charges that are not recognized can be clarified by
sending an email to: [email protected] Within 15 calendar days
following the unrecognized charge. Charges that have not been
clarified within this period will not be refundable.

Whenever applicable, you agree to pay for all content licensed
through the Service, and "Cosmindie" may charge your credit card for
any licensed content and any additional amounts (including any taxes
or late fees, as applicable) that may be incurred on your Account or in
relation to your Account.

YOU ARE RESPONSIBLE FOR TIMELY PAYMENT OF ALL FEES
AND FOR PROVIDING "COSMINDIE" WITH VALID CREDIT CARD
DATA FOR PAYMENT PURPOSES OF ALL FEES.

Prices and content availability are subject to change at any time, at
the sole discretion of "Cosmindie," and will be notified through the
email address used for account creation and through the website
www.cosmindie.com and/or the mobile app of the Service.

Your use of the Service includes the ability to enter into agreements
and/or make transactions electronically. YOU ACKNOWLEDGE THAT
THE INFORMATION TRANSMITTED ELECTRONICALLY
CONSTITUTES YOUR CONSENT AND MANIFESTATION OF
INTENT TO BE BOUND BY SUCH AGREEMENTS AND
TRANSACTIONS AND TO PAY FOR THEM. YOUR CONSENT AND
INTENT TO BE BOUND THROUGH INFORMATION TRANSMITTED
ELECTRONICALLY APPLY TO ALL RECORDS RELATED TO ALL
TRANSACTIONS ENTERED INTO ON THIS WEBSITE, INCLUDING
CANCELLATION NOTICES, POLICIES, CONTRACTS, AND
ORDERS.

18 - Taxes

By official provision, all services provided over the Internet in Mexico
generate payment of the Value Added Tax at the percentage
established by Mexican laws that are in force at the time of collection.
Therefore, the final price (including taxes) may vary from time to time
without liability to "Cosmindie." Published prices include all taxes.

Service transactions will include the taxes that correspond according
to the billing address and the percentage of the tax in force at the time
the transaction is completed. If the tax rate for the billing address is
modified before the licensed content is downloaded, the new tax rate
in force at the time of download will be applied.

We will only charge taxes in countries where such transactions require
the calculation and withholding of the corresponding tax. No customer
has the right to tax exemption for transactions made on the Service.

19 - Pincodes

These are promotional codes that can be redeemed for, free of
charge:

a. Download a limited number of songs (Free Download);

b. Access a "Cosmindie" plan (Free Plan); or

c. Access "Cosmindie" for a specific period (Free Days).

In the case of receiving a Pincode, please note the following:

a) To activate the Free Plan or Free Days Pincode, it may be
necessary to subscribe to a "Cosmindie" plan with the indication of a
valid form of payment;

b) Free Plan or Free Days Pincodes may have different durations;

c) Subscriptions under Free Plan or Free Days Pincodes can be
canceled at any time;

d) At the end of the Free Plan or Free Days subscription, you may be
charged for the selected plan through the registered payment method.
If a payment method is not requested, there will be no charge at the
end of the promotional period;

e) You are only entitled to activate one code per payment method.

Promotion conditions:

The user must subscribe to a monthly unlimited music plan and
register a valid form of payment. Valid for users without an active plan.
Not applicable with other promotions. At the end of the promotional
period, the contracted plan will be charged through the registered
payment method. The subscription can be canceled at any time. Not
applicable for song downloads. More details on the validity of this
promotion and all available plans in Terms and Conditions.

The duration of the promotional period varies depending on each code
(1, 2, 3, 6, 12, or 18 months).

20 - Included Mobile Data Benefit

Applies to "Cosmindie" Users who subscribe to an unlimited music
plan (Monthly Subscription). Applies to active subscriptions; current
subscriptions will see the benefit reflected on their next renewal after
the benefit release date. Not cumulative with other promotions.

Restrictions:

THE INCLUDED DATA DO NOT APPLY TO THE REPRODUCTION
OF RADIO STATIONS AND PODCASTS WHEN THE USER IS
DIRECTED TO ANOTHER SITE. DOES NOT APPLY TO
SUBSCRIPTIONS WITH CHARGES TO OTHER PAYMENT
METHODS, EVEN IF YOU HAVE LINKED YOUR "COSMINDIE"
ACCOUNT TO A NUMBER AS A MEANS OF AUTHENTICATION TO
ACCESS THE SERVICE.

If the data line is canceled by the customer or due to non-payment,
the benefit will be lost.

If the Subscribed User changes their subscription to a different one
from the Participating Subscriptions, the benefit will be lost.

If the "Cosmindie" subscription is canceled by the customer or due to
non-payment, the benefit will be lost.

In the case of the "Monthly Plan" subscription, the benefit will apply
only to the account holder who subscribed and made the payment.

The use of data for the "Cosmindie" service while in international
roaming will be charged according to the data usage rates applicable
in the visited country.

21 - Refunds

Occasionally, technical issues may delay or prevent the delivery of
content selected by the User. Your sole and exclusive remedy
regarding content not delivered within a reasonable time will be the
replacement of that content or a refund of the price paid for it, as
determined by "Cosmindie." Otherwise, no refunds will be available.

22 - General Provisions

"Cosmindie" reserves the right to take any reasonably necessary or
appropriate measures to enforce and/or ensure compliance with any
part of this Agreement (including, without limitation, the right of
"Cosmindie" to cooperate in any legal process related to the use of the
Service, and/or in a third-party claim that your use of the Service is
illegal and/or violates the rights of such third parties). You agree that
"Cosmindie" has the right, without liability to you, to disclose any
Registration Data and/or Account information to law enforcement
authorities, government officials, and/or third parties, to the extent
"Cosmindie" reasonably considers it necessary or appropriate to
enforce and/or verify compliance with any part of this Agreement
(including, without limitation, the right of "Cosmindie" to cooperate in
any legal process related to the use of the Service, and/or in a third-
party claim that your use of the Service is illegal and/or violates the
rights of such third parties).

These Terms and Conditions constitute the entire Agreement between
you and "Cosmindie" and govern your use of the Service, prevailing
over any prior agreements. You may still be subject to additional terms
and conditions that may be applicable when using affiliate services,
third-party content, or third-party software.

If any part of these Terms and Conditions is deemed invalid or
unenforceable, that part shall be interpreted to the extent possible in
accordance with applicable law to reflect the original intentions of the
parties, and the remaining provisions of the Agreement will remain in
full force and effect. If "Cosmindie" fails to enforce any rights or
provisions of these Terms and Conditions, it shall not constitute a
waiver of such provision or any other provision of these Terms and
Conditions. If any provision of this Agreement is deemed invalid by a
court with competent jurisdiction, the other provisions shall remain in
full force and effect. "Cosmindie" shall not be responsible for the
failure to fulfill any obligation due to causes beyond its control.
